1. Acceptance of Terms

Welcome to Fjala! These Terms of Service ("Terms") govern your access to and use of the Fjala mobile application (the "App" or "Service"), provided by Fjala ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you (the parent, legal guardian, or authorized adult user) and Fjala. You must be at least 18 years old or the age of majority in your jurisdiction to agree to these Terms on behalf of a child user.

2. Description of Service

Fjala is an educational mobile application designed to help children ages 3-8 learn the Albanian alphabet through interactive lessons, tracing exercises, and educational games.

The Service Includes:

• Access to the Albanian alphabet (36 letters) with native pronunciation
• Interactive letter tracing exercises
• Educational games and activities
• Progress tracking and parent dashboard
• Offline learning capability
• Letter A available for free
• Full access available through paid subscription

We Reserve the Right To:

• Modify, suspend, or discontinue any part of the Service
• Update content and features
• Change pricing with advance notice to existing subscribers
• Limit access to certain features or content

3. Subscription Terms

Free Content

Letter A and basic app functionality are available for free with no subscription required. You may use this content indefinitely without payment.

Paid Subscription

Full access to all 36 letters and premium features requires a paid subscription:

• Monthly Plan: €3.99 per month
• Yearly Plan: €39 per year (save €8.88 compared to monthly)
• Free Trial: 3-day free trial for new subscribers
• Billing: Recurring charge through Apple App Store or Google Play Store
• Auto-Renewal: Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Price Changes: We may change subscription prices with at least 30 days' notice. Changes affect new subscribers immediately and existing subscribers at their next renewal

Payment

• Payment is processed through your Apple App Store or Google Play Store account
• You will be charged at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Prices are in Euros (EUR) and may vary slightly by region due to App Store/Google Play currency conversion

Cancellation

• You may cancel your subscription at any time through your App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to paid features until the end of the paid period
• No partial refunds for unused portions of a subscription period
• Local learning progress remains on your device after cancellation

4. Refund Policy

All purchases are processed through Apple App Store or Google Play Store and are subject to their respective refund policies.

Refund Requests

• iOS Users: Request refunds through Apple at reportaproblem.apple.com
• Android Users: Request refunds through Google Play Store within 48 hours of purchase
• Refunds are granted at the sole discretion of Apple or Google
• We do not process refunds directly but will assist with refund requests

Free Trial

• If you cancel during the 3-day free trial, you will not be charged
• You must cancel at least 24 hours before the trial ends to avoid being charged
• One free trial per Apple ID or Google account

5. User Responsibilities

As a User, You Agree To:

• Use the App only for lawful educational purposes
• Provide accurate account information
• Maintain the security of your account credentials
• Supervise children's use of the App as appropriate
• Not share your subscription with others outside your household
• Not reverse engineer, decompile, or attempt to extract source code
• Not remove copyright or proprietary notices
• Not use the App in any way that could harm or impair its functionality
• Not attempt to gain unauthorized access to any part of the Service

You Agree NOT To:

• Share, copy, or distribute app content without permission
• Use automated systems (bots, scrapers) to access the Service
• Modify or create derivative works based on the App
• Use the App for commercial purposes without authorization
• Violate any applicable laws or regulations
• Attempt to circumvent payment or subscription requirements

6. Parent and Guardian Requirements

Fjala is designed for children and requires parent or guardian oversight:

• You must be 18+ or of legal age to create an account and manage subscriptions
• You are responsible for all activity under your account
• You consent to the collection of limited child information as outlined in our Privacy Policy
• You are responsible for ensuring age-appropriate use
• You have the right to review and delete your child's information at any time
• You understand that the App is an educational tool and does not replace traditional instruction

7. Intellectual Property

Our Rights

All content in the Fjala app, including but not limited to:

• Text, graphics, images, and illustrations
• Audio recordings and pronunciations
• Software code and algorithms
• Tracing templates and educational materials
• Games and interactive activities
• The Fjala name, logo, and branding

...are owned by or licensed to Fjala and protected by copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial educational purposes
• Access content included with your subscription level

Restrictions

You may not:

• Reproduce, distribute, or publicly display app content
• Create derivative works or modifications
• Use content for commercial purposes
• Remove or alter copyright notices
• Sell, rent, lease, or sublicense the App

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to our data practices as described in the Privacy Policy, including:

• Collection of minimal necessary information
• COPPA compliance for children under 13
• Local and cloud storage of learning progress
• No third-party sharing for marketing purposes

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected
• Warranties regarding specific educational outcomes or results

We do not guarantee that:

• The App will meet all your requirements
• Your child will achieve specific learning outcomes
• The Service will be available at all times
• All errors or bugs will be fixed

Educational Disclaimer: Fjala is designed as a supplementary educational tool. It does not replace formal education, professional instruction, or parental guidance. Learning outcomes vary by individual child.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FJALA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or learning progress
• Loss of profits or revenue
• Loss of use or access to the Service
• Device damage or malfunction
• Costs of substitute services

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fjala, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content or data you provide
• Your child's use of the App under your supervision

12. Third-Party Services

The App may integrate with third-party services:

• Apple App Store / Google Play Store: For app distribution and payment processing
• Cloud Storage Services: For optional progress backup

Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services or their practices.

13. Termination

Your Rights

You may stop using the App at any time and cancel your subscription as described in Section 3.

Our Rights

We may suspend or terminate your access to the App:

• If you violate these Terms
• If we suspect fraudulent or unauthorized use
• If required by law
• If we discontinue the Service (with reasonable notice)

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Your subscription (if active) will not be refunded unless required by law
• Local data on your device may remain but cloud data may be deleted
• Sections of these Terms that should survive termination will remain in effect

14. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the United States and the State of [Your State], without regard to conflict of law provisions.

Dispute Resolution

Arbitration

• You may bring claims in small claims court if they qualify

Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

15. Changes to Terms

We may update these Terms from time to time to reflect:

• Changes in our Service or features
• Legal or regulatory requirements
• Industry best practices

Notification of Changes

When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you through the App or email for material changes
• Continued use after changes constitutes acceptance
• If you don't agree to changes, you should stop using the App and cancel your subscription

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fjala regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control.

17. Apple App Store Additional Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Fjala, not Apple
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for any product warranty claims
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with all applicable third-party terms when using the App
